1. About these terms
These Terms of Service (the “Terms”) are a legal agreement between you and the individual sole trader operating PicShots (the “Operator”, “we”, “us”). For privacy questions, take-down requests, or any other notice under these Terms, contact us at support@picshots.app or via the contact page.
2. The service
PicShots provides tools to create event pages, collect guest-submitted photos and short videos subject to the limits a host configures, and share resulting galleries via links or QR codes. The Service is provided “as is” and “as available” and may change, be paused for maintenance, or be discontinued at our discretion.
3. Accounts and eligibility
To host an event you must create an account using a working email address and sign in via the magic link we send to that address. You are responsible for everything that happens under your account, including all events you create and any guest access codes you share. You must be at least 16 years old to use the Service. You may not use the Service if you are barred from doing so under the laws of your country.
4. Host responsibilities
As a host, you are solely responsible for:
- your event settings, including who you share the guest link or guest PIN with, and keeping your host account credentials private;
- complying with all laws applicable to your event and the place it takes place;
- obtaining any required permissions, image-rights releases, or consents from the people who appear in photos or videos uploaded to your event (including consents required under applicable image-rights, civil-code, GDPR/UK GDPR, or state-of-publicity laws);
- moderating guest uploads, including removing content that you find inappropriate;
- providing your guests with any information they need about how their submissions will be used and how long they will be kept.
You agree to indemnify and hold us harmless from any claim brought by a third party (including a guest or an individual shown in an upload) arising out of your event, your settings, or the content collected through your event, except to the extent the claim arises from our own breach of these Terms.
5. Guest content
By uploading a photo or video to a PicShots event, you confirm that:
- you own the upload or otherwise have the right to share it;
- the upload does not violate anyone’s privacy, publicity, or intellectual-property rights;
- the upload does not contain unlawful, hateful, harassing, or sexually explicit material, or material depicting minors in any sexualised context;
- you grant the event host, and us solely to the extent needed to provide the Service to that host (host dashboard, gallery page, downloads, backups), a worldwide, royalty-free, non- exclusive licence to host, display, store, transmit, and create the storage-format derivative files (e.g. compressed WebP image, generated thumbnails) required to deliver the Service. This licence ends when the upload is deleted, subject to short-term backup retention described in our Privacy Policy.
The host of your event controls the gallery; the host may delete or moderate your upload at any time. You can also delete your own upload from the same device you uploaded it on, using the in-page “My uploads” controls.
6. Acceptable use
You may not, and must not allow anyone else to:
- upload content that is unlawful, infringing, defamatory, obscene, hateful, harassing, threatening, or that depicts or exploits minors;
- attempt to gain unauthorised access to any host account, host PIN, guest PIN, event, or our infrastructure;
- use the Service to send spam or to harvest information about other users;
- upload malware, attempt to overload our endpoints, reverse- engineer the Service, or evade our rate-limit or abuse controls;
- scrape, copy, or republish galleries you do not own without the host’s express permission.
We may remove any upload or event, suspend any account, or block any IP address that we reasonably believe violates these Terms or creates risk to the Service or to other users.
7. Plans and fees
The Service offers a free tier and paid event tiers as described on our pricing page. Paid tiers are charged on a per-event basis and not as a recurring subscription. Prices, guest caps, shot caps, and add- ons may change; the version effective at the time you purchase an event applies to that event. Where you pay through a third- party payment processor, that processor’s terms also apply to the payment. Taxes (where applicable) are your responsibility unless explicitly included in the displayed price. Refunds, cancellations, and chargebacks are governed by our Refund Policy.
8. Intellectual property
The Service, including its source code, design, look-and-feel, brand assets, and copy, belongs to the Operator and is protected by applicable intellectual-property laws. Except for the limited licence to use the Service granted to you in these Terms, nothing in these Terms transfers any of those rights to you. Hosts and guests retain the rights to their own uploaded content, subject to the licence in section 5.
9. Copyright complaints
If you believe content on PicShots infringes your copyright, email support@picshots.app with (a) identification of the copyrighted work, (b) the URL or event slug containing the alleged infringement, (c) your contact information, (d) a statement that you have a good-faith belief the use is not authorised, and (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights-holder or authorised to act on the rights-holder’s behalf. We will respond to valid notices promptly and, where appropriate, remove the content and notify the relevant host.
10. Termination
You may stop using the Service and delete your account at any time from /profile. We may suspend or terminate your access if you breach these Terms, if your use poses a security or legal risk, or if we are required to do so by law. Sections that by their nature should survive termination (including sections 5, 7, 8, 11, 12, and 13) will survive.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. We do not warrant that uploads, galleries, or any data will be retained without loss, that the Service will be free from defects, or that it will meet your specific requirements.
12. Limitation of liability
To the maximum extent permitted by law, the Operator’s total aggregate liability to you for all claims arising out of or in connection with the Service is limited to the greater of (a) the amount you have paid us for the Service in the twelve months immediately preceding the event giving rise to the claim, or (b) USD 50. In no event will we be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenues, lost data, or loss of goodwill, even if we have been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law (including, for UK / EU consumers, liability for death, personal injury caused by negligence, or fraud).
13. Governing law and disputes
Except where applicable consumer-protection laws give you additional rights, these Terms and any dispute arising out of them are governed by the law of the Operator’s country of residence, and the courts of that country have non-exclusive jurisdiction. Consumers resident in the UK or EU may also bring proceedings in the courts of their country of residence, and are entitled to the benefit of any mandatory provisions of their local consumer-protection law.
14. Changes to these terms
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the current version. For material changes that affect your rights or obligations, we will use reasonable efforts to give you advance notice (for example, by email or in-app notice). Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
